these are tough rules
Do:
Fly your drone during daylight and in good weather (not in clouds or fog).
Keep your drone in sight, where you can see it with your own eyes – not only through an on-board camera, monitor or smartphone.
Make sure your drone is safe for flight before take-off. Ask yourself, for example, are the batteries fully charged? Is it too cold to fly?
Know if you need to apply for a Special Flight Operations Certificate (SFOC).
Respect the privacy of others – avoid flying over private property or taking photos or videos without permission.

Don’t fly:
closer than nine km (five nm) from any aerodrome (i.e. airport, heliport, helipad or seaplane base, etc.)
higher than 90 metres (300 feet) above the ground
closer than 150 metres (500 feet) from people, animals, buildings, structures, or vehicles
in populated areas or near large groups of people, including sporting events, concerts, festivals, and firework shows
near moving vehicles, highways, bridges, busy streets, or anywhere you could endanger or distract drivers
within restricted and controlled airspace, including near or over military bases, prisons, and forest fires
anywhere you may interfere with first responders

I will find this hard as I fly in a right of way and it could be 500 feet from a building

You say 'Right of way'......so not a busy street.


And you are not actually flying up and down the Right of way but standing on it flying in the vicinity? Doesn't seem too reckless if it is a fairly quiet area.

How close to the building? 400? 350? I mean they give the 500 but if you are staying a sensible distance and flying in control.....and maybe even go ahead and land if somebody curious comes near?

Does that describe your situation? If so it would seem like a reasonable level of compliance to me.

And how big of a machine are we talking about?

Mmmmmm, yeah. You are starting to get a bit large for being very near any person/building etc.

What is you reason for flying an expensive craft like that?

Are you getting into photo business?

In that case the "Best Practices" you linked would lead you to see the need for SFOC.

not a business , just an interest also have the phantom 2 with goggles
guess I better look into the SFOC!
I have been doing this for 3-4 yrs, looks like it may be a bit more difficult to fly around populated areas

Just getting a SFOC doesn't negate where or how the "drone" is operated . Best to read up as to how the operation is allowed .
