Interesting result especially since the AMA did not directly support or endorse this lawsuit. The Feds may appeal or they may lobby the government to change the underlying rules. I won a case for a client in Calgary 20 years ago where we challenged the definition of a "commercial" vehicle (which was not allowed to be parked in a private yard). Afterwords the lawyer for the City told me that they would simply rewrite the bylaw to outlaw the type of vehicle my client had....
Ie. they may have won the battle but by poking the bear in the eye, they may ultimately still lose the war...?

Seems like a conundrum wrapped in an enigma.

The Modernization act prohibits them from making any rules. So how could you do any re-write that would be allowed?

But could they go after changing the modernization act, or would that be prohibited because the motive for doing so is prohibited?

Will they even bother pursuing it because the strict definition would allow LOS modelling without registration; and was the original motivation to actually go after Long Range/Improper Venue FPV flying?

Did they just poke The Bear in the eye or did they break his Ray Ban's too?

The thing that pisses me off about this is they waited long enough that pretty much anyone who wants to fly in the U.S. Has already gone thru the pain of the registration, etc, etc.

Now some other stupid new rule is going to Come in to replace the old one - probably made up by a pissed off and angry bear - and we're going to have to repeat it all over again.

In the meantime, what happens to us that registered with the FAA? Will they be deleting those records or will it "stay on file"? Hmmm.....

As one with the FAA UAS registration, I will just leave the decals on my aircraft just in case things get reversed someday. So far as the registration goes I can't see it to be any different than your DL, or health card, or license plates........or border crossing
