Can I get in trouble for this?

I ordered a "r/c helicopter" off of ebay and after charging the battery it swelled up and nearly caused a fire. I sent the seller a few e-mails waited almost a week, no response so I filed a paypal claim and left a neg feedback.
Today I recieve 4 messages:

option 1, if you withdraw this case from paypal and withdraw the negetive. we will not take any leagal action against you and you will have negative feedack withdrawn too. plus, I can offer a free wall adapter and 50% off a charger and battery, but you need pay actual shipping cost.

option 2, you do nothing. let paypal decide who win. we would have our lawer file possille buyer fraud against you. our lawer would also forward evidence to Canada customs and request an investigation on all the shipment you got. you would subject to all serious penalties descriped by CANADA law if it exceed certain limit, you would also subject to illeagal importing investigation. You will also get a negative from us. and we will not offer any part or discount.

if I don't hear from you within 24 hours, we will assume you want to go with option 2. then we will have our lawer take action immediately.

who ever is playing a game with threats is the one that will be getting themself in trouble

My question is. If he leaves negative feedback, will it be legible?

I won't give any advise because I don't know anything about CANADA law.

Seriously though. Sorry for your troubles. I personally would not withdraw the complaint.

I have bought things from EBay in the past and can tell you that it would have never been delivered to you if Canadian Customs had not been satisfied that all the t's were crossed and the i's dotted. They have obviously sold you defective merchandise and it is up to them to honor their "agreement". They are trying to either buy you off (option 1) or scare you off (option 2). Follow the course you are on. I think I would also be tempted to forward their so called "offer" to both EBay and Paypal.

No trouble

Mutual feedback withdrawal allows members to withdraw feedback for a transaction if both members are able to agree on a resolution. Withdrawn feedback is not counted in the feedback score or rating totals, but remains in the list of comments.

I 'd go with sending a copy of this to Ebay and Paypal and see what they say about it. They use threats to scare you off, at least they could spell some of it correctly. Tell them your lawyer awaits the "evidence" and see what happens.

Damnit, should have gotten to this thread ealier, I didn't want any further troulbe and went with opt.#1 I am a minor and don't want my parents to get into any trouble.
He said he would report me to customs because I asked him to declare item as $50 instead of actual value to avoid taxes.

sorry for the late response. this is because we were closed for the past week due to relocating. if you check our listings, you would find that we don't have any ongoing listings. we have setup auto-responding email, but you won't get those message,because you contected us via ebay. anyway, we just open again today again at CA.

now for this mater, the king you get is indeed with upgraded tail, the bad tail looks different. and we never stock that version. for the charger and battery, it's common knowledge, that the puff up thing is most likely caused by over-dis-charge rather than charging. So I don't believe your statement.

we follow all ebay and paypal guildlines and all U.S. laws. we did nothing wrong in this case.

as you can tell I tried my best to help you with shipping and answering all your questions, but we still end up with this. Be honest, we didn't make any profit on your sale. you got a good deal is just because we were relocating and try to get things out. I'm very dispointed with you. from my many year sale experience, I kind of got the feel that we would end up like this.

Anyway, very shortly after you contact us, you filed dispute, this is a typical pattern of buyer fraud in an effort to get 'free stuff'.
We have won all the previous dispute case from paypal because we always follow their guildline and provide certified proofs.
I have request certification from esky and will forword to paypal. Paypal would also know that you are dishonest, because you left a paypal note in the original transaction that you want declare less customs value and wrong info. you also have left negative feedback, so you have done all possible damage to us. Now it's our turn. I'll offer several options below, we can have this solved nicely and you won't have any trouble, or you will get some real trouble, depending on which way you want to go, it's your call, man.
